Please read these terms & conditions carefully before ordering from our website, as they may affect your rights and liabilities under the law, and they set out the terms under which bathroomshopuk.co.uk supplied any of the listed products to you.

 

1. Use of this Site

1.1 All orders made on this website will be governed by these terms and conditions, and are between you and bathroomshopuk.co.uk, not with any other party.
1.2 By placing an order with us you warrant that you are at least 18 years old, and are legally capable of entering into a binding agreement.
1.3 This website is for your personal use and is subject to these terms and conditions, and by using this website you agree to be bound by them; they do not affect your statutory rights.

 

2. Pricing

2.1 The prices payable for your products will be those quoted on the website at the time of order; except in cases where obvious errors have been made, then we will not be liable to supply that product to you at the incorrect price.
2.2 It is always possible due to the large number of products on the website and manufacturer price increases, that some prices may be incorrect. We will contact you if this has occurred, and come to a resolution between us.
2.3 All prices are in pounds sterling and inclusive of VAT at the current rate.
2.4 The price of the product does not include delivery, this will be calculated at check out and varies depending on the size / fragility of the product.
2.5 Errors and Omissions expected.

 

3. Availability and Delivery

3.1 If for any reason beyond our reasonable control, we are unable to supply a particular item, we will notify you as soon as possible.
3.2 If the goods that you ordered are not available, we reserve the right to substitute goods of a similar specification and quality.
3.2 Your order will be fulfilled as soon as possible unless otherwise informed, and will be delivered to the address given on your order.
3.3 For palletised deliveries, your order will be taken as close as possible to your front door. If this is unreachable for any reason, then the order will be delivered as near to your property as possible. The driver is not insured to take goods inside your property.
3.4 All deliveries are by third-party carriers. If you are not able to take delivery of the products, depending on the carrier used, your goods will either be stored at the depot nearest to your address until you can collect them, or the carrier will attempt to redeliver the goods to your address.
3.5 We shall use our best endeavours to secure delivery within our advertised timescales, but shall not be liable for loss occasioned by delay in delivery arising out of any cause beyond our control.
3.6 We advise not to book in any trades people until your delivery is complete, we are not liable for any costs incurred to you from your trades people.
3.7 If you order items with different availability dates, we will hold all the items until the last item is delivered. You may however choose to have each item delivered separately and we reserve the right to charge you a delivery charge each time.
3.8 If our couriers cannot make a delivery you will be contacted by either us or the couriers to arrange a re-delivery, If you do not respond and the items are returned to us you will be subject to a charge.
3.9 If the item needs re-delivering there will also be a re-delivery charge, as per the original delivery fee.
3.10 Once your order has been delivered, you have 48 hours to notify us of any damages.

 

4. Risk and Title

4.1 At the time of delivery, the products will be at your risk, and the title ownership of the products will  pass to you once you delivery is complete.

 

5. Acceptance

5.1 All orders are subject to acceptance by us, and there will be no contract between you and us unless and until we dispatch the goods to you.
5.2 At any point up until the despatch of goods, we may decline to supply the goods to you without giving any reason.
5.3 If we decline to supply goods and payment has already been made, we shall refund you within 30 days of declining your order. We shall not be obliged to offer you any additional compensation for the disappointment caused.
5.4 If the goods that you ordered are no longer available, we reserve the right to substitute goods of a similar specification and quality. You be contacted prior to any substitution.

 

6. Cancellation

6.1 You have the right to cancel your order before your order is despatched, either by phone call or email.
6.2 You do not have the right to cancel your order for the supply of any products:
1) that have been custom made to suit your specifications,
2) are special / made to order products (if a product has a lead time of more than 2 weeks, it is automatically classified as a ‘special’ product),
3) which by reason of their nature cannot be returned.
6.3 This provision does not affect your statutory rights.

 

7. Returns

7.1 As stated in clause 3.10, you have 48 hours to notify us of any damages to your product. If your product arrived to you damaged, and is not caused by you (including plumber or another installer), we will arrange a replacement to be sent to you. If we are notified after this point and any damaged goods have been fitted in any way they will be rejected, example:  bath feet fitted, tap holed drilled or wastes fitted. 
7.2 You have the right to return your product/s to us within 30 days of receiving it, as long as you have notified us by email or phone prior to doing so.
7.3 Products must be returned to us in a new, resaleable condition, with no damage to the original packaging and all parts still present.
7.4 It is your responsibility to ensure that the product is returned with a suitable courier, and all costs will be incurred by you.
7.5 No returns will be accepted if the product was a special / made to order item.
7.6 Please check to see if your order is affected by a restocking charge before returning any products. We only ever pass on restocking charges for productsthat are non-stock or direct ship products, these restocking charges are the charges passed to ourselves from our suppliers. 
7.7 When your return has been inspected and approved, a refund will be issued (minus the delivery / restock) back via the original payment method.
7.8 Returns should be sent to : Bathroom Shop UK, Unit 5 Ings Mill, Ossett, WF5 9HQ please make sure your original order number, name and date of order is included with the returned product/s. 

 

8. Payment

8.1 You can pay through the payment gateway ‘Stripe’ by all major credit and debit cards, and also through Klarna (for full details see our dedicated Klarna page).
8.2 Your payment details will be encrypted to minimise the possibility of unauthorised access or disclosure. Authority for payment must be given at the time of order.

 

 

 

9. Intellectual Property

9.1 The content of this website is protected by copyright, trademarks and other intellectual property rights.
9.2 You may retrieve and display the content of this Website on a computer screen, or mobile device and store such content in electronic form on disk (but not any server or other storage device connected to a network) or print one copy of such content for your own personal, non-commercial use, provided you keep intact all and any copyright and proprietary notices.

10. Our liability

10.1 This website is provided by bathroomshopuk.co.uk without any warranties or guarantees. You must bear the risks associated with the use of the Internet.
10.2 If you do not receive goods ordered by you within 30 days of the date on which you ordered them, or by the date given in any correspondence we shall have no liability to you unless you notify us via the indicated methods of the problem within 30 days of the date on which you ordered the goods.
10.3 You must observe and comply with all applicable regulations and legislation, including obtaining all necessary customs, import or other permits to purchase goods from our website. The importation or exportation of certain of our goods to you may be prohibited by certain national laws. We make no representation and accept no liability in respect of the export or import of the goods you purchase.
10.4 Nothing in these terms and conditions is intended to limit any rights you might have as a consumer under applicable local law, or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.
10.5 To the full extent allowed by applicable law, you agree that we will not be liable to you/or any third party for any consequential or incidental damages (including but not limited to loss of revenue, loss of profits, loss of anticipated savings, wasted expenditure, loss of privacy and loss of data) or any other indirect, special or punitive damages whatsoever that arise out of or are related to this website.

11.1 This website may include links to other websites or materials which are beyond our control. bathroomshopuk.co.uk is not responsible for content on the Internet or World Wide Web, or any other website outside this website.

 

12. General

12.1 These Terms shall be governed by and construed in accordance with the laws of   England and Wales and any disputes will be decided only by the English courts.
12.2 If any of these terms is held by any court of competent authority to be unlawful, invalid or unenforceable, in whole or in part, this will not affect the validity of the remaining terms which will continue to be valid and enforceable to the fullest extent permitted by law.
12.3 You may not assign, sub-licence or otherwise transfer any of your rights under these terms.
12.4 If you breach these terms and bathroomshopuk.co.uk ignores this, bathroomshopuk.co.uk will still be entitled to use its rights and remedies at a later date, or in any other situation where you breach the terms.

14.1 We suggest that you do not schedule any installation until you have received and checked your goods. We recommend the installation is carried out by a professional with full regard to expert plumbing practices, taking into account British Standards and normal sizes of any other products used.
